Demolition of Illegal Buildings, the Rich Guy and the Principle of Caveat Emptor…

By Fred Edoreh When I saw the video of the rich guy whose illegal building in the premises of Dennis Osadebey University, Anwai-Asaba, was marked for demolition, three things struck me. As a fellow human being, I sympathised with his loss, but I lost that sense of sympathy when I heard the arrogance of wealth in his words as he insulted the school and attempted to blackmail the government. Hear him: “This is my house. I have put over N100 million on it. I started building it in November and I did not stop. This is not the only one. I have many other properties in this place. Tell me, can the school build this kind of property? Instead of the government to call me… You that are working here, is your house as fine as this? How much are you being paid?” Maybe, those words came out of desperation, but they conveyed a sense of ignorance, pride and carelessness, perhaps, the reason why he fell into the predicament. The fact of the matter is that the guy, like many others affected, knowingly or unknowingly, purchased a portion of the land acquired by government and allocated to Dennis Osadebey University. The acquisition of the expanse of land had been gazetted as allocated to the school, then School of Agriculture, as far back as during the military era when Ibrahim Kefas was Governor of Delta State, and subsequently renewed under the immediate past administration of Governor Ifeanyi Okowa. It is standard practice for governments to acquire lands for government institutions, schools, military installations, agricultural reserve and so on. Only recently, Governor Sheriff Oborevwori allocated lands for the Federal University of Medical Sciences, Kwale, the School of Health Technology, Ovrode, and to the Nigerian military for the establishment of some security installations. The lands may be large in view of projections for future development and, in this case, being first a School of Agriculture, the need for space for demonstration farms and other practical processes must have been factored in. Whether all the expanse of land have been fully put into use or not, over time, cannot be any reason for encroachment by individuals. Persons who may have built private hostels there are said to have gone into legitimate agreement with the school. Those now affected by the demolition obviously were surreptitiously sold the lands by unscrupulous land grabbers and speculators. These are often without Certificate of Occupancy as should have been signed by the Governor, except forged documents. The school had been having a hell of a time stopping them from the encroachment but they were either encouraged to proceed by the criminal sellers or they may have banked on compromising the system to force their new ownership or, still, to overturn the ownership of the land through spurious litigations. The point must be made that no responsible government would condone the spate of encroachments and illegal developments on reserved lands. The Honourable Commissioner for Lands and Survey, Chief Emamusi Obiodeh, had from the inception of the administration sounded a warning to illegal occupiers and developers of government lands to desist and even invited those who feel they have genuine claims to approach his ministry with their documents for verification and authentication. Even on the Dennis Osadebey University land, the Director General of the State Task Force on Government property, Chief Frank Omare, invited all non-state developers to a meeting at the Government House to give them the opportunity to present and prove their claims, with windows provided for the certification of legitimate occupiers. Truth is society thrives on order. There are rules, there are laws, there are regulations, and in the acquisition of property, there is always the principle of “Caveat Emptor.” The principle of “Buyer Beware” means that it is always the responsibility of the buyer to crosscheck with the Ministry of Lands and Survey and its land administration offices on the status of any land or built property it wants to buy, no matter what documents it is presented with by the seller. This is because you cannot build something on nothing, talk less of building a property on a land that is not legally and legitimately yours but to a school. The questions that arise are simple: Is the land under government acquisition? Yes. Is the acquisition gazzeted? Yes. Was it sold to the buyer by the government or by the school authority? No. Did the buyer secure any agreement with the school or the government to make any development on the land? No. Who sold the land to the buyer? Criminal land grabbers and dupes. Did the buyer do any due diligence to confirm the status of the land before purchasing? Most probably not. Is the government and the school in their right to reclaim their property from the illegal developers? Clearly yes. Even if we are to plead ignorance, which however is no excuse before the law, such ignorance could have been earlier cured if our rich guy had simply been mindful to consult a property lawyer to verify the status of the land before acquiring and investing on it. That probably would not have cost up to a million Naira. If nothing else, the Bible  recommends knowledge and information for good living. Who then is to pay for any loss that may be incurred by acting out of ignorance or in carelessness? Why is there property law and property lawyers? These are no-brainers. Indeed, by our national experience, from the days of Malam Nasir el Rufai as Minister of the FCT, when various buildings not in sync with the Abuja Masterplan were demolished, Nigerians should have been conscious of the imperative of running due diligence on any property they want to acquire. The process has not been abated even under the current administration of President Bola Ahmed Tinubu and the ministration of Nyesom Wike. I’m desperate for effective political leadership for my country and for my State.By the grace of God, providing health, energy and the resources,I will continue to fight for good political leadership in my State and in my country.I was privileged to school in Nigeria and in the United Kingdom, and I know that the main factor that is responsible for development in the developed world and the backward trend in Nigeria/ Edo State is leadership.The British man or woman is not more intelligent than an Edo man or woman.If you make efforts to convince me that Edo man and woman cannot refine petrol,you are only wasting your time because I will not believe you.If Iam elected as governor of Edo State,the Dons  in UNIBEN, AAU and Auchi Polytechnic will refine petrol in my 100 days in office.We cannot continue with a litre of petrol for almost 900 Naira. Not even one (1) out of the 109 Senators in Nigeria rejected the 160 million Naira jeep for the interest of their Constituency.Not even one(1) out of the 360 House of Rep members rejected the 160 million Naira jeep for the sake of the suffering people in their Constituency. The APC gubernatorial candidate is a Senator and his running mate is a member of the House of representatives.They collected the over priced jeep at the expense of Edo people.In a truly democratic nations,no political party will present such characters as candidates of the party.In any case , they were not elected by the delegates of the APC ,but were nominated by godfathers that are determined to loot the resources of Edo State.They should be rejected by Edo State voters. In 1999 , Edo State ministry of local government and Chieftaincy affairs arranged for a higher purchase of  18 brand new peogeot 504 Best Line official cars for the newly sworn – in local government Chairmen in Edo State.I was the ONLY Chairman out the 18 local government Chairmen in the 1999-2002 set that rejected the official car.You can verify from my colleagues,or any official of the ministry of local government and Chieftaincy affairs in 1999.I politely rejected the new car for reasons that it was not the priority of the people of Uhunmwode Local Government Area that elected me into  office and I didn’t want to add my official car to the financial burden of the local government. My contest for the governorship of Edo State is based on my confidence that I have verifiable patriotic past records and previous achievements in public office that I am proud of and ready to improve upon. I have not said that APGA is the only good political party in Nigeria, but I have evidence to show to the good people of Edo State that APGA has records of producing good characters and performing governors.Peter Obi was governor of Anambra State for two terms on the platform of APGA.Nigerians appreciated his performance as governor of Anambra State and gave him the support for good governance in Nigeria. The present governor of Anambra State,Prof Chukwuma Soludo was elected on the platform of APGA.While Edo State is sinking with a huge debt burden,Prof Soludo in his two years plus as governor of Anambra State has not borrowed a kobo. I share in similar background of University of Nigeria, Nsukka Alumni with governor Peter Obi and Prof Soludo.Our political ideology is similar and I will work to surpass the records of the APGA governors in Anambra State. I’m the first elected Chairman of Uhunmwode Local Government Area to reside in Ehor, the headquarters of Uhunmwode Local Government.The Council quarters that I built in Ehor is the largest Council quarters to be found in any part of Edo State .Anybody can go to Ehor to verify. Let no governorship candidate hide under the platform of any political party,or boast with the factors of incumbency.Edo State voters should demand all the candidates to come forward with their history and past achievements that impacted on the lives of their communities or the State. Peter Obi left PDP for LP because of the high nomination fees for presidential primaries.It is not an offense for me to move to APGA if I believe that the nomination fees of my former political party is too high for the common man and that my former political party has been hijacked by one man for the purpose of advising his personal interest. Edo voters should ignore the migration of PDP to APC, and APC to PDP, and elect a candidate, not a political party platform that will work for the people of Edo State. It is obvious that the godfathers are determined to steal the resources of Edo State and they should be disappointed by rejecting their nominated candidates. DELTA POLICE  ARREST 38 YEAR OLD CAMEROONIAN OVER KIDNAP

BY JAMES IGBINOSA Police have nabbed 38 year-old Cameroonian and two other Suspected kidnappers while attempting to abduct unsuspecting residents of Warri for ransom. Thepolice  spokeman, SP Bright Edafe,  who confirmed the arrest gave the names  of  others as, Yakubu Ya’u, 20 year, from Kaduna State and Musa Yakubu ‘m’ age 25yrs from Kogi State. Edafe explained that the Suspects were  kidnapping incidents in the Warri axis, and kidnapping was being carried out by Yakubu Ya’u, who resides in Kaduna, but always comes to Oha and Ughwagba Communities in Okpe council of the State to kidnap unsuspecting residents for ransom. He said the Police got winds of the Suspects carrying out their oparations on May 11, 2024 at about 1743hrs, and immediately swung into action to do the needful. ” And following combined effort from police operatives of the command and operatives from the Force Intelligence Unit, Abuja on the hideout of the suspect, the DPO Orerokpe, CSP Paul Oboware, immediately mobilized and led his patrol teams to the hideout in Warri, and after a painstaking search of the entire area, the said Yakubu Ya’u was arrested.  “Preliminary investigation and interrogation of the suspect led to the arrest of two other key gang members: one Musa Yakubu ‘m’ age 25yrs from Kogi State and one Abdulahi Mohammed ‘m’ age 38yrs from Cameroon, at about 1049hrs. According to him, the suspects were allegedly responsible for several kidnapping incidents in Orerokpe, Sapele, Warri, and environs. He said at their hideout in Ughwagba community in Okpe local government area of the State, two Automatic Pump Action Guns, One Live Cartridge, and one knife hidden and buried in the bush were recovered.  Bright Edafe disclosed that Preliminary investigations in the matter are still ongoing, while efforts to arrest other fleeing members of the gangs are on top gear. The Police image maker also confirmed the arrest of a 31 year Chinedu Okolo residing at Ezhionum Community. According to Edafe, at 0300hr, the DPO Obiaruku Division received a report from a distress caller, that he was being bullied and forced into a cult initiation. On the strength of the complaint, the Police mobilized and arrested the suspect, Chinedu Okolo with one Locally Made Double Barrel Pistol and the handset forcefully taken from his victim were recovered, instantly. Following this development, the CP Abaniwonda Olufemi cautioned the youths to shun all forms of criminality, cultism, and abuse of drugs. He reassured the public that the police would not relent in pursuit of those who seek to disrupt the collective peace of the state.

DELTA STATE GOVERNMENT TO EMPOWER 250 PERSONS WITH DISABILITIES WITH  HEALTH  SCHEME

BY JAMES IGBINOSA No fewer than 250 persons with disability drawn from the 25 local Government Areas of Delta State have benefited from the State contributory Health Insurance scheme. The Director General and Chief Executive Officer of the State Contributory Health Commission, Dr. Isaac Akpoveta, made the disclosure yesterday when he received on Courtesy visit, the Joint National Association of Persons With Disability at the Commission headquarters in Asaba. Dr. Akpoveta said that the beneficiaries comprised 10 Persons With Disability drawn from each of the 25 Local Government areas. According to him, their Health Insurance was paid for to enable them receive quality healthcare services and be protected from financial hazards of high cost of medical care. Dr. Akpoveta said through initiatives like the Indigent Enrollee Adoption Initiatives, Artisans Enrollee Inducement Initiatives and the Delta State Health Insurance Commission strived to break down barriers and create a more inclusive healthcare system that caters to the diverse needs of the people. While acknowledging the unique challenges faced by Persons With Disabilities including, social stigma, discrimination, and limited access to essential services, he said It is the collective responsibility of citizens to challenge such barriers and create an inclusive society that respects and values the contributions of every citizen. Earlier, the leader of the delegation and Chairman of the Joint National Association of Persons With Disability Comrade Ernest Igbozor had appealed to the Commission to provide a soft landing for their members to enable them received healthcare without any form of hitches.

Edo State Deputy Governor, Engr Godwins Omobayo, has assured the people of ward 04 in Akoko-Edo Local  Government Area of more infrastructural development, upon assumption of office by Asue Ighodalo as Edo State Governor, come November 12 . The Deputy Governor gave the assurance during a sensitization rally, organized by the leadership and supporters of PDP in the ward, as part of its campaign for the upcoming September 21, govership election.  It was a carnival-like event, as son of the soil, Omobayo(Deputy Governor) and his entourage were treated to a rousing reception. The Deputy Governor who was highly elated by the massive turnout of the people and  residents of the area, assured them of inclusive participation when Asue Ighodalo assume office as Governor of Edo State. Obaseki, step up strategy to reduce homicide, and tackle cultism

The Edo State Governor, Mr. Godwin Obaseki, has decried the rising incidents of homicide in the State, noting that the government and security agencies in the State are working assiduously to check violent crimes and tackle cultism in the State. Obaseki said this while briefing journalists after the maiden Security Council Meeting for 2024, held with security chiefs in the State at the EXCO Chamber, in Government House, Benin City, the Edo State capital. On the sidelines of the security meeting, the governor also received the newly deployed Commander, 4 Brigade Nigerian Army, Brig Gen Ebenezer O. Oduyebo and Commissioner of Police, Edo State, Funso Adegboye. The governor said the Council reviewed data on crime from July to December 2023, noting that homicide recorded the highest numbers of incidents which can be linked to cult-rated activities. According to him, “We have just concluded the maiden Security Council Meeting for the year and reviewed crime indices, not only for December but for the last six months of 2023. We reviewed the data from July to December and noticed that the biggest security challenge we have in Edo State today is homicide, arising largely from cult-related activities and probably community clashes. “From the month of December alone, out of the 83 incidents reported, 24 are related to homicide. For the last six months in 2023, for instance, out of 500 incidents reported, 135 had to do with homicide and we lost 135 people from mostly cult-related activities and community clashes. “This is an issue of concern to the State and the Council took a decision to delve deeper into the data to understand the specific situation and reasons driving this high level of homicide in the State.” The governor further noted that the Security Council mandated the Commissioner of Public Safety, Kingsley Uwagbale to work with security agencies to tackle cultism in the State, noting, “Cultism will be addressed from two distinct approaches which include ensuring diligent investigation and prosecution of cult related crimes and ensuring high publicity to the crime through the prosecution process. Secondly, we need to get to the root cause of this high incidence of cultism.” Obaseki added, “The Commissioner for Public Safety, working with security agencies and institutions of higher learning in Edo State will be carrying out some activities including sensitization at different public fora and perhaps a conference within the next few weeks to make sure we sensitize parents and members of the Community more on the issue of cultism. “As it relates to the possibility of increased incidence during political activities, we got assurance from various security agencies that action will be stepped up to make sure that venues are adequately protected during such activities and encourage political parties to inform security agencies when carrying out such political activities.”

Edo setup Environmental Court

By Osas Idemudia The Edo State Government has set up a mobile court to prosecute defaulters of environmental issues so as to serve as a deterrent to those who flout environmental laws in the state. The Commissioner for Environment and Sustainability, Joshua Omokhodion, made this known at a stakeholders meeting on environmental sanitation and pollution control tagged: ‘Edo Must Be Clean and Serene’, held at the New Festival Hall in Government House, Benin City. The State Government held a  stakeholders meeting with  market women, religious leaders, and community leaders,  where a 10-point resolution was signed to keep the state clean and green. The commissioner call for collaboration among stakeholders as the  best way to solve the challenges of waste disposal in Edo State. The major  point of the meeting was the signing of the 10-point resolution on how to keep the environment and State clean by leaders of various groups present. The 10 points are “No indiscriminate dumping of refuse on road median, walkway; all market to be kept clean or shut down; no burning of refuse as offenders will be apprehended and prosecuted/fined; no littering or throwing out litters from vehicles; mobile Court set up to prosecute offenders; no noise pollution.

Ondo gov, Aiyedatiwa dissolves state exco, sacks all Akeredolu’s aides

By Editor Lucky Aiyedatiwa, the Ondo state governor,  has dissolved the State Executive Council (SEC) with immediate effect. In a statement made available to journalists on Wednesday in Akure, by the  Chief Press Secretary to the governor,  Ebenezer Adeniyan, all members of the cabinet are to immediately hand over to the Permanent Secretaries or the most senior administrative officers in their respective offices. The council was  dissolved  after 28 days in office as governor of Ondo state after the death of the former governor Oluwarotimi Akeredolu. According to the  statement, “ all Senior Special Assistants (SSAs) and Special Assistants (SAs) are relieved of their duties, with immediate effect. “All the affected officials are directed to hand over all government properties in their possession. “The Governor thanks the affected officials for their services and contributions to the development of the state.”
